These Terms and Conditions ("Terms") apply to the Unique winter perspective competition 2015 (“Competition”) as described below.
These Terms shall apply between Canon Europa N.V. (registered in Amsterdam under registration number 33166721 having a place of business at Bovenkerkerweg 59, 1185 XB Amstelveen, The Netherlands, and other Canon group companies “Canon”) and You, the entrant of the Competition (“You”).
By submitting Your image(s) to participate in this Competition, You agree that You have read, understood and accepted these Terms.
1. COMPETITION ENTRY
1.1 This Competition is open to all residents of United Kingdom, Germany, France, Spain, The Netherlands (“Territories”) aged 18 years or over (or with the permission of an adult to enter). Employees of Canon and their immediate families, the agencies or anyone professionally connected with this Competition, as well as Canon Masters, Canon Ambassadors and Canon Explorers are not eligible to participate.
1.2 The Competition theme is Iconic Images (the “Theme”) and the “Uploading Period” is Opening Date 09:00 (CEST) on 2nd November 2015 to Closing Date 23:59 (CEST) on 30th November 2015
1.3 To enter the Competition you must upload one (1) image relating to the Theme (Unique winter perspectives Images) to the Canon Gallery and provide a short description of your entry including the story behind it. All entries must be uploaded within the Uploading Period; uploads outside of the Upload Period will not be accepted for entry to the Competition but may still be displayed on the Canon Gallery, Canon Showcase and on Canon’s Social Media platforms.
1.4 All images uploaded in connection with this Competition will be accessible for other entrants to view and all valid entries will be displayed on the Canon Gallery. By uploading Your image and entering the Competition, You explicitly agree to such use.
1.5 Canon cannot be held responsible for any entries not received due to technical problems.
1.6 Canon reserves the right to disqualify any individual which, at its sole discretion, it believes has tampered with the entry process or who has breached any terms of this Competition.
2. PRIZE SELECTION
2.1 Twenty (20) images will be shortlisted (“Shortlist Winners”) from all European entries. From the twenty Shortlist Winners. From the Shortlist Winners, one (1) image will be selected as the overall Grand Prize Winner. Judging will be based on technique, creativity and original and interesting interpretation of the Theme “Unique winter perspectives” in the absolute discretion of the judges. Representatives of Canon will Shortlist Winners. Grand-Prize winning entry will be decided by a Canon Ambassador Richard Walch. All decisions about winning entries is final and no discussion will be entered into by the Canon Ambassador or Canon.
2.2 Shortlist-Winners of the November’s competition will be chosen between the Closing Date and 1700 CET on 11 December 2015 and Grand Prize Winner will be chosen by 2359 CET on 18 December 2015.
2.3 Canon will contact the Grand Prize Winner within 48 hours of the close of judging. Only those entrants that can verify their entries comply with these Terms will be able to win any prize.
2.4 Winners will be notified via email. Winners have fourteen (14) days within which to respond to notification of winning in order to verify their entry and confirm acceptance of the prize offered. If no response is received in this time, Canon may withdraw the offer and reallocate the prize in its sole discretion.
2.5 Grand-Prize Winner competition will be announced on 14 January 2016 on the Canon Gallery and via Canon’s Social Media platforms in all Territories during the month of January.
Canon will inform Electronic Arts Limited of the winner of the photo competition. Electronic Arts Limited will liaise with the winner as appropriate. The prize must be claimed within 45 days after the winner is announced. The Electronic Arts Limited are the provider of the prize. The prize is including:
3.2 TRIP TO CALIFORNIA
Any incidental costs incurred by the winner (such as telephone calls, facsimile charges, Internet charges, Spa/beauty salon services, laundry, tours/excursions, gift shop purchases, hotel processing fees and airline service charges) are the sole responsibility of the winner. The winner and the other person designated by the winner as the person taking part in the prize must have a valid passport and are responsible for securing all visas required to visit the US. Entry to the racetrack is subject to the Terms and Conditions of the racetrack. EA is not providing insurance, which shall be the winner’s responsibility. At least one of the people travelling must be an adult (18 or over). Electronic Arts Ltd. may replace the prize or any part with an alternative of equivalent value if necessary (for example if the Formula D event is cancelled). There is no cash alternative available to the winner.
3.3 OTHER PRIZES

The voucher is supposed to be claimed in the online store of Zavvi.com. The voucher is valid and must be claimed till the 31st March 2016.
3.4 Canon will endeavour to deliver applicable prizes to verified winner within 30 days of their acceptance of the prize. Any prize not accepted, returned to sender or undeliverable due to inaccurate details, will be deemed unwanted and the prize will be revoked.
3.5 All Winners must confirm acceptance of their prize within 14 days of notification. Prizes not accepted within 14 days of notification will revert to Canon and may be relocated to another entrant at the absolute discretion of Canon.
3.6 Absolutely no cash or other prize alternatives are available in whole or in part save that in the event that the specified Prize is not available for any reason, Canon has the right to provide an equivalent prize of equal or higher specification and/or value.
3.7 Prize winners are responsible for any obligations related to their winning of any Prize as may be applicable.
4. IMAGE REQUIREMENTS FOR VALID COMPETITION ENTRY
4.1 Entrants must own or control all of the rights to any image uploaded for this Competition and You must have the absolute right to enter the image into this Competition having obtained the permission of any other person who may have any right or interests in the image uploaded.
4.2 All images must be provided in their original files if requested by Canon.
4.3 Images will be deemed invalid (and will not be able to win any prize) if they do not comply with the following requirements. You must not upload images that contain:
(1) Recognisable persons, unless You can demonstrate that such persons have granted all the necessary permissions for his/her image to be used and published by Canon under these Terms; or
(2) Works of art, unless You can demonstrate that You have been granted a licence to have such works of art used and published by Canon under these Terms;
(3) Logos and brand names, unless You can demonstrate that You have been granted a licence to have such logo or brand names used and published by Canon under these Terms;
(4) Anything illegal or anything that may infringe rights of Canon or any third party;
(5) Anything discredits or denigrates anyone’s image, personal reputation or commercial reputation.
(6) Anything which may be considered obscene, immoral or in any way inappropriate or unpleasant including nudity and violence etc.
4.4 You may undertake digital manipulation in order to optimise an image, but adding or removing key elements is not allowed. Composite or collage images, from more than one image, are not eligible for entry into the Competition.
4.5 You must pay for all royalties, fees and any other monies that are owed to any person by reason of any image uploaded by You in connection with the Competition.
License - By uploading your image to the Canon Gallery and entering into this Competition, you hereby grant to Canon (including all Canon group companies, affiliates, their sub-licensees and authorised agents), a Europe, Russia, Central Asia and Middle East & Africa (“EMEA”) wide royalty-free assignable non-exclusive licence (“Licence”) to use, reproduce, publish and republish (whether in its entirety or in a cropped or edited format) Your uploaded image(s) for the purpose of operating and promoting this Competition whether on the internet (including without limitation on any Canon Facebook Pages or Twitter Pages), on any Canon website or any authorised third party website or by means of any social media without limit in time. Winning images may also be used on third party media sites, within EMEA without limit in time. You hereby warrant that You have all necessary rights and authority to enter into this agreement and grant such licence to Canon, its affiliates, sub-licensees and agents. You hereby expressly waive any moral rights You and/or any other person may have in the image You submit.
4.7 You also agree to be contacted by Canon for the purposes of administrating the Competition or in the event that Canon wishes to discuss any other use of the image submitted to the Competition.
4.8 Canon reserves the right to disqualify incomplete, illegible entries or any entry which otherwise does not meet the above requirements.
4.9 You must comply with applicable terms and conditions and/or policies of Canon and the Canon Gallery.
5.1 Canon will only use Your image in accordance with the licence described above and will only use any personal information supplied with Your image for the purposes of administering the Competition including, but not limited to, contacting You and announcing the Winners and identifying you as owner of the Image.
5.2 You allow Canon to feature your image in the Gallery, Content Library and on Canon’s Social Media platforms within EMEA , along with your credit, at no charge.
5.3 You own the image and you are happy to be acknowledge as its owner and author.
5.4 You have permission from anyone shown in the image and any other rights holders who are associated with this image, to submit this image.
5.5 You acknowledge Canon moderates all images before display within the Gallery, Content Library and on Canon’s Social Media platforms.
5.6 Canon may contact you to request further information regarding your image.
5.7 You hereby explicitly consent to Your personal information being transferred and processed within European Union by Canon (including any Canon group company or agent authorised by Canon acting on its behalf) in association with this Competition and use of the Images as described herein.
5.8 For the purpose of this Competition, the data controllers of Your personal information are Canon Europa N.V. registered in Amsterdam under registration number 33166721 having a place of business at Bovenkerkerweg 59, 1185 XB Amstelveen, The Netherlands; and Canon Europe Limited registered in United Kingdom under a registration number 4093977 having a place of business at 3 The Square, Stockley Park, Uxbridge UB11 1ET, United Kingdom.
6.1 Canon shall not be liable for any failure to meet these Terms of Competition where such failure is caused by any supervening circumstances amounting to force majeure. Such circumstances shall include, but shall not be limited, to severe weather conditions, fire, flood, war, earthquake, riots, industrial dispute, terrorism, acts of god, or such events that impact supply of any product to be awarded as a Prize or, events that, without fault of either party, render performance impossible or incapable of satisfactory execution.
6.2 By entering into the Competition, You agree to release and hold Canon harmless from and against any claim or cause of action arising out of participation in the Competition or receipt or use of any Prize.
7.1 Owing to exceptional circumstances outside its reasonable control and only where circumstances make this unavoidable, Canon reserves the right to cancel or amend the Competition or these Terms at any stage but will always endeavour to minimise the effect to You in order to avoid undue disappointment.
7.2 As a consumer, the Laws of your country of residence will apply to this Competition, and you may be entitled to bring court proceedings in your own language and in your local courts. A local consumer advice organization will be able to advise you of your rights. These Terms and Conditions do not restrict any statutory rights that may be applicable. If you are not a consumer according to your local Laws, the Laws of England and Wales will apply to this Competition and the parties agree to exclusive jurisdiction of the courts of England and Wales.
