Canon Online Silent Auction Terms & Conditions

1.1. The Promoter is Canon Europa N.V and registered at Bovenkerkerweg 59, 1185 XB, Amstelveen, the Netherlands (“Canon”). Any company, any subsidiary, partnership or other entity which from time to time is controlled by or is under common control of Canon hereinafter will be referred to as “Canon Affiliate” and, Canon and Canon Affiliate together will be referred to as "Canon Group".

1.2. All entrants (“Participants”) must be residents of Germany, Austria, Switzerland, France, Spain, Portugal, Italy, Norway, Sweden, Denmark, Finland, United Kingdom, Ireland, Netherlands, Belgium, Luxembourg, Czech, Hungary, Poland, Slovakia, South Africa, Bahrain, Iran, Iraq, Jordan, Kuwait, Lebanon, Oman, Qatar, Saudi Arabia, Syria, United Arab Emirates, Yemen, Algeria, Benin, Burkina Faso, Burundi, Cameroon, Cape Verde, Central African Republic, Chad, Comoros, Democratic Republic of Congo, Djibouti, Egypt, Equatorial Guinea, Eritrea, Ethiopia, Gabon, Ghana, Guinea, Guinea-Bissau, Ivory Coast, Kenya, Liberia, Libya, Mali, Mauritania, Morocco, Niger, Nigeria, Republic of Congo, Rwanda, Sao Tome E Principe, Senegal, Sierra Leone, Somalia, South Sudan, Sudan, Tanzania, The Gambia, Togo, Tunisia, Uganda, Western Sahara, Bulgaria, Croatia, Cyprus, Greece, Malta, Romania, Slovenia, Serbia, Latvia, Lithuania, Estonia, North Macedonia, Ukraine, Bosnia-Herzegovina, Israel, Tajikistan, Uzbekistan, Armenia, Azerbaijan, Angola, Botswana, Lesotho, Madagascar, Malawi, Mauritius, Mayotte, Mozambique, Namibia, Reunion, Saint Helena, Seychelles, Swaziland, Zambia and Zimbabwe aged 18 or over.

1.3. By entering this auction, all participants are deemed to have agreed to be bound by these terms and conditions unless notified otherwise in writing.

2.1. Entry Period: Enter between 00:01 GMT on 19th June 2023 and 23:59 on 30th June 2023 inclusive.

2.2. Visit https://www.canon.co.uk/silent-auction-hillingdon-hospital/ to complete the online form to provide your details (name, email address, bid amount).

2.3. It is free to enter this auction. The highest bidder for each image will need to pay the submitted bid amount to Hillingdon Hospital Trust via a Just giving page which will be shared to the winning bid.

2.4. Internet access and a valid email address are required to enter.

2.5. Incomplete, invalid, or entries received after the closing date on the 30th June 2023 at GMT 23:59 will not be eligible for entry or any prize.

2.6. The winner of each image does not own the rights to the image. The person who took the original image is the owner of the proprietary rights of the image.

3.1 The highest bidder of each image will win a print and framed image.

3.2. Canon will notify all successful bids via the email address provided on entry within 5 working days of the closing of the silent auction and will be required to respond to confirm eligibility and acceptance of the Prize, within 14 calendar days of initial contact. If the winner does not respond to the initial contact within 14 calendar days, Canon reserves the right to offer the prize to the next highest bidder.

3.3. The Prize is non-transferable, and no cash or credit alternatives will be substituted for the prize on offer.

3.4. The Prize will be posted to the winner within 30 calendar days after the winner is contacted and the successful bid amount has been paid to the Hillingdon Hospital just giving page. In the unlikely event that a Prize doesn’t arrive within 30 calendar days after the winner is announced, the winner will have a further 28 calendar days to inform Canon by emailing corporate.communicaitons@canon-europe.com. If the winner does not inform Canon within this time frame, Canon will reserve the right to not reissue the prize or limit its value at their sole discretion.

3.5. In the event that the silent auction is not capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, dishonesty, technical failures, or any other causes beyond the control of Canon which corrupt or affect the administration, security, fairness, integrity or proper conduct of this auction, Canon reserves the right to disqualify any individual who tampers with the entry process or does not comply with these Terms & Conditions and to cancel, modify or suspend the auction or invalidate any affected entries.

4.1. Canon Europa N.V., 59 Bovenkerkerweg, 1185 XB, The Netherlands, is the Data Controller in respect of any personal data supplied by Participants. The personal data provided is held securely and may be transferred on a secure server outside the country of the data subject’ domiciles. The personal data collected from Participants is subject to the Canon Business Privacy Policy https://www.canon-europe.com/privacy-policy/.

4.2. Any and all personal data supplied for the running of this competition will be used solely for the purpose of this competition and, will not be used, for marketing purposes by the Canon Group and will not be disclosed to a third party for any other purpose unless your positive consent has been obtained.

5.1. Canon reserves the right to refuse to honour any entry or to recover the full value of any prize if it considers there has been an abuse or breach of the terms and conditions of this auction.

5.2. Canon together with any associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this auction or accepting or using the Prize, except for any liability which cannot be excluded by law. Nothing will exclude the Canon Group’s liability for death or personal injury as a result of its negligence.

5.3. In the event of a dispute over interpretation or implementation of the rules on any matter related to the auction, the decision of the Directors of Canon is final and no correspondence will be entered into.

5.4. If any part of these conditions is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable, then such part shall be severed from the remainder of these conditions, which shall continue to be valid to the fullest extent permitted by law.

5.5. Entries must be made directly by the individual entering the competition. Bulk entries from trade, consumer groups or third parties will not be accepted. Incomplete or illegible entries and entries submitted by macros or other automated means together with entries which do not satisfy the requirements of these Terms & Conditions in full will be disqualified and will be not be counted. If it becomes apparent that a Participant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that Participant’s entries into the competition in a way that is not consistent with the rules of the competition, that Participant ’s entries will be disqualified and any prize awarded will be void. Participant are not permitted to enter using anonymous email services such as, but not limited to, GuerillaMail, Dispostable or Mailinator.

5.6. In the event of a discrepancy between these Terms & Conditions and the details in any promotional material, the details in the Terms & Conditions will prevail.

As you are a participating consumer, laws of your country of residence will apply to this competition, and You may be entitled to bring court proceedings in your own language and in your local courts. A local consumer advice organization will be able to advise you on your rights. These Terms do not restrict any statutory rights that may be applicable.
