CANON (UK) LIMITED- 2025 ‘STORIES IN MOTION’ COMPETITION sponsored by CREATIVE VIDEO PRODUCTIONS LIMITED (the “Competition”)
Terms and Conditions
1. PROMOTER AND PARTICIPANTS
1.1. The promoter is Canon (UK) Limited a company registered in England (number 01264300) and whose registered office is at 4 Roundwood Avenue, Stockley Park, Uxbridge, UB11 1AF (the “Promoter”). Any company, any subsidiary, partnership or other entity which from time to time is controlled by or is under common control of Promoter hereinafter will be referred to as “Canon Affiliate” and, Promoter and Canon Affiliate together will be referred to as "Canon Group".
1.2. All entrants (“Participants”) must be aged between 18 and 25 and a resident in the UK.
1.3. Employees of Creative Video Productions Limited a company registered in England (number 2391457) with its registered office at 23 Shield Drive, West Cross Industrial Estate, Brentford, Middlesex. TW8 9EX. United Kingdom (“Sponsor”), Promoter, their subsidiary companies, their families, agents and other parties directly involved with this Competition are not eligible to enter.
1.4 By entering this Competition, all Participants are deemed to have agreed to be bound by these terms and conditions (“Terms and Conditions”) unless notified otherwise in writing.
2. THE COMPETITION
2.1. Entry Period: Enter between 10:00am GMT on 2nd December 2024 and 23:59 BST on 31st March 2025 inclusive.
2.2. The Competition consists of three four competition categories (each a “Category”) within the Competition that may be entered into as follows:
a. Music Video
b. Documentary
c. Fictional Short
d. Commercial
2.3 To enter:
(i) visit:https://www.canon.co.uk/get-involved/competition/stories-in-motion and complete the online entry form; and
(ii) submit a maximum of one (1) audio visual film entry per Category (each an “Entry”). Participant may enter any or all Categories; and
(iii) each Entry must meet the criteria listed below in Clause 3.
2.4 No purchase is necessary. It is free to enter this Competition and Entries do not have to be created using a Canon device.
2.5. Internet access and a valid email address are required to enter.
2.6. A maximum of four (4) Entries, one per Category are permitted per person during the Entry Period. Each Entry per category must be materially different in the final opinion of the Promoter, the same Entry cannot be submitted for multiple Categories. Participant may be shortlisted in multiple Categories, but can only win in one Category regardless of the number of Categories they submit an Entry for.
2.7. Incomplete, invalid or inappropriate Entries, or Entries received after expiry of the Entry Period will not be eligible for publication or any Prize.
2.8. By submitting an entry, each Participant hereby grants to Canon Group a non-revocable, worldwide, royalty-free, free of charge, sublicensable licence to publish, republish, display and use their Entry for all purposes connected with this competition, including but not limited to display on Canon Group websites, social media accounts and/or channels, any other websites of third party agents/contractors, Sponsors, and in marketing materials (including at exhibitions) relating to this Competition. Each Participant also grants Canon Group and its agents/contractors the right to moderate, modify or remove any Entry deemed unsuitable, in whole or in part, for display on the Competition website or in any materials relating to the Competition. Participants of the Competition also hereby agree to being identified and/or attributed as the Director of Photography or creator of the Entry.
3. ENTRY CRITERIA
3.1. Entries submitted to the Competition must fall into one of the applicable Categories.
3.2 The Entry submitted in any of the Categories must reflect the following criteria:
a. Cinematography – including lighting and camera movement
b. Post-production – including editing, colour and grading of the Entry
c. Originality – the subject matter and creativity of the Entry
3.2. Each Entry should be a maximum of five (5) minutes in length with a maximum file size of 150mb and submitted in MP4 file format. Participants must not upload Entries which have previously won an award or prize via a promotion run by the Promoter or any other third party.
3.3. Each Entry must contain a minimum of fifty percent (50%) of live action footage.
4. COMPETITION REQUIREMENTS
4.1. The Entry must be original and taken by the Participant.
4.2. The Entry submitted by the Participant must not contain:
i) recognisable persons, unless the Participant can demonstrate that such persons have granted all the necessary permissions in writing for their name, image, likeness to be incorporated within an Entry and for such Entry to be submitted, used and published by Canon Group under Clause 2.8 of these Terms and Conditions (please note, it is the responsibility of the Participant to ensure that the relevant permission has been sought and model/participant release forms have been satisfactorily completed); or
ii) works of art unless the Participant can demonstrate that the Participant has been granted a licence to have such works of art incorporated within an Entry and published by Canon Group under Clause 2.8 of these Terms and Conditions or
iii) logos or brand names unless the Participant can demonstrate that the Participant has been granted a licence to have such logos or brand names incorporated within an Entry and published by Canon Group under Clause 2.8 of these Terms and Conditions; or
iv) scenes which are offensive, obscene, sexual, derogatory, defamatory, disproportionately violent, abusive, harassing, threatening, objectionable with respect to race, related to religion, origin or gender, or which could reflect negatively upon the name, reputation or goodwill of Canon Group, Sponsor or any brand partner, or which are otherwise unsuitable for publication; or
v) anything that may infringe the rights of any third party, including intellectual property, moral or privacy rights, or refer to any third-party brand or reference any third-party names, logos and/or trademarks; or
vi) any watermark, copyright notice or any other information which may identify the Participant (note, a copyright notice embedded in the metadata of the film is permissible). For the judging process to remain as fair as possible, the judging panel is not permitted to see the names of the Participants when judging. Any Entry submission that contains a Participant’s name, any watermark, copyright notice or any other information which may identify the Participant, will be disqualified and will not be presented to the judging panel.
4.3. Participant agrees to be contacted by Promoter, Sponsor or any other authorised third party for the purposes of administering the Competition or in the event that Canon Group wishes to discuss any other use of the Entry.
5. WARRANTIES
5.1 By submitting its entry, the Participant warrants that:
(i) the Participant is the sole author of the Entry;
(ii) the Participant is the owner of the proprietary rights in the Entry;
(iii) the Entry and any element appearing in the Entry do not infringe any rights (including intellectual property, moral or privacy rights) of any third party;
(iv) in the case where a person or person’s name, image or likeness appears in the Entry, the Participant has obtained written permission from those person(s) for Canon Group to use their name, image(s) or likeness as described in these Terms and Conditions; and
(v) in the case where the Entry has been filmed in another country than in the Participant’s country of residence, the Participant has complied with the law applicable to such country, including but not limited to any intellectual property, moral, privacy and proprietary legal requirements of that country.
5.2 Promoter warrants that it shall act within the scope of the rights granted under and/or in accordance with these Terms and Conditions.
6. THE PRIZES
6.1. There will be three (3) Entries shortlisted for each Category within the Competition totalling twelve (12) shortlisted entries overall (each a “Shortlisted Entry”). Each Shortlisted Entry will receive the following prizes:
(i) Invitation to the awards ceremony taking place on the 24th April 2025 in London (the “Awards Ceremony”) for the Participant and three guests.
(ii) One (1) gift voucher of Two Hundred Pounds (£200.00) redeemable against purchases made on the Sponsors web store located at www.cvp.com.
6.2. One (1) category winner will be selected from the Shortlisted Entries for each Category (each a “Category Winner”) totalling four (4) Category Winners. Each Category Winner will receive the following prize:
(i) One (1) gift voucher at the value of Five Hundred Pounds (£500.00) redeemable against purchases made on the Sponsors web store located at www.cvp.com.
6.3 One (1) grand prize winner will be selected from the four(4) Category Winners (the “Grand Prize Winner”). The Grand Prize Winner will receive the following prizes:
(i) One (1) Canon EOS C80 Camera and Canon RF 24-70 F2.8 L lens.
(ii) One (1) day shadowing one of the Competition judges of their choice in their field of work
6.4. The following are excluded from any of the prizes described in Clause 6.1, 6.2 and 6.3:
(i) Any expenses and costs of attending the Awards Ceremony including but not limited to transportation to and from the Awards Ceremony venue, parking and accommodation.
(ii) Meals and refreshments (other than those provided during the Awards Ceremony for all attendees).
(iii) Travel or any other insurance coverage.
7. AWARDS CEREMONY TERMS
7.1 The Awards Ceremony invitations are strictly for the Participants of each Shortlisted Entry and their three (3) nominated guests and may only be substituted in exceptional circumstances by written confirmation from the Promoter (email being sufficient).
7.2 Participants of Shortlisted Entries will be asked to take part in a promotional film captured by Promoter during the Awards Ceremony for its own promotional use online and on social media (the “Promotional Film”). Any Shortlisted Entry Participants who do not wish take part in the Promotional Film can opt out by notifying the Promoter in writing (e-mail being sufficient) before commencement of the Awards Ceremony.
7.3 Promoter will notify the Participant of a Shortlisted Entry via the email address provided on submission (the “Notification”) and shall require confirmation of receipt of such notification and availability to attend the Awards Ceremony within five (5) working days of receipt of the Notification (“Response Period”). If a response is not received within the Response Period Canon reserves the right to disqualify that Shortlisted Entry and select an alternative Entry to be shortlisted.
7.4. Canon reserves the right to publish the name and town and county of the Shortlisted Entries to promote the Competition and/or to publicise the Awards Ceremony. If a Participant of a Shortlisted Entry does not wish such details to be published, they must advise Canon at time of being notified that they have been shortlisted.
7.5. The prize is non-transferable and no cash or credit alternatives will be substituted for the prize or any part of the prize on offer. In the event that the prize offered or any part of the prize offered is unavailable due to circumstances beyond Promoter’s control, Promoter reserves the right to offer an alternative prize of equal or greater value.
7.6. Any rejected or unclaimed prize may be awarded to other Participants at the absolute and sole discretion of the Promoter.
7.7. In the event that the Competition is not capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, dishonesty, technical failures, or any other causes beyond the control of Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition, Promoter reserves the right to disqualify any individual who tampers with the entry process or does not comply with these Terms and Conditions and to cancel, modify or suspend the Competition or invalidate any affected entries.
7.8. No responsibility can be taken for entries which are lost, delayed, corrupted, damaged, misdirected or incomplete or which cannot be delivered for any technical, delivery or other reason. Proof of sending will not be accepted as proof of receipt. Canon Group does not guarantee continuous or secure access to the entry page.
8. WINNER SELECTION
8.1. All valid entries received during the Entry Period will be judged by a panel of four judges. There will be a total of two (2) rounds of judging to nominate the Shortlisted Entries. From the twelve (12) Shortlisted Entries, the judging panel will select four (4) Category Winners and one (1) overall Grand Prize Winner to be announced at the Awards Ceremony.
8.2. The Shortlisted Entries, Category Winners and Grand Prize Winner will be selected between the 1st April 2025 to the 6th April 2025 inclusive.
9. PERSONAL DATA
9.1. Promoter is the Data Controller in respect of any personal data supplied by Participants. The personal data provided is held securely and may be transferred on a secure server outside the country of the data subject’ domiciles. The personal data collected from Participants is subject to the Canon Consumer Privacy Policy https://www.canon.co.uk/privacy-policy/.
9.2. Promoter may pass personal information relating to entrants or prize winners to the Sponsor and related organising bodies (and any of their service providers or agents) for the purposes of (a) monitoring the distribution and use of the Awards Ceremony invites and, in the event of a suspected breach of any terms and conditions, rules or regulations relating to the use of such invites, investigating and taking action against such winners (and their crew if applicable)
9.3 Any and all personal data supplied for entering this Competition will be used solely for the purpose of this Competition and, if applicable, for marketing purposes by the Canon Group and/or by any agent or third party supplier appointed by it to assist with running the competition on behalf of the Promoter and will not be disclosed to a third party for any other purpose unless your positive consent has been obtained.
10. DISCLAIMER
10.1. Promoter reserves the right to refuse to honour any entry or to recover the full value of any prize if it considers there has been an abuse or breach of these Terms and Conditions.
10.2. Promoter together with Sponsor, any associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using the prize, except for any liability which cannot be excluded by law. Nothing will exclude the Canon Group’s liability for death or personal injury as a result of its negligence.
10.3. In the event of a dispute over interpretation or implementation of the rules on any matter related to the Competition, the decision of the Directors of the Promoter is final and no correspondence will be entered into.
10.4. If any part of these conditions is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable, then such part shall be severed from the remainder of these conditions, which shall continue to be valid to the fullest extent permitted by law.
10.5. Entries must be made directly by the individual entering the competition. Bulk entries from trade, consumer groups or third parties will not be accepted. Incomplete or illegible Entries and Entries submitted by macros or other automated means together with entries which do not satisfy the requirements of these Terms and Conditions in full will be disqualified and will be not be counted. If it becomes apparent that a Participant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that Participant’s entries into the Competition in a way that is not consistent with the rules of the Competition, that Participant ’s entries will be disqualified and any prize awarded will be void. Participants are not permitted to enter using anonymous email services such as, but not limited to, GuerillaMail, Dispostable or Mailinator.
10.6. In the event of a discrepancy between these Terms and Conditions and the details in any promotional material, the details in these Terms and Conditions will prevail.
11. JURISDICTION
These Terms and Conditions shall be governed by English Law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
