CANON (UK) LIMITED- BETWEEN THE LINES STUDENT PHOTOGRAPHY 2022 COMPETITION- Terms and Conditions

1. PROMOTER AND PARTICIPANTS

1.1. The Promoter is Canon (UK) Limited and whose registered office is at 4 Roundwood Avenue, Stockley Park, Uxbridge, UB11 1AF (“Canon”). Any company, any subsidiary, partnership or other entity which from time to time is controlled by or is under common control of Canon hereinafter will be referred to as “Canon Affiliate” and, Canon and Canon Affiliate together will be referred to as "Canon Group".

1.2. All entrants (“Participants”) must be a student at a United Kingdom (UK) college or university with a valid UK student ID, aged 18 or over and a resident in the UK.

1.3. Employees of Canon, its subsidiary companies, their families, agents and other parties directly involved with this promotion and the sponsorship are not eligible to enter.

1.4 By entering this competition, all Participants are deemed to have agreed to be bound by these terms and conditions unless notified otherwise in writing.

2. THE COMPETITION

2.1. Promotion Period: Enter between 00:01 BST on 26th May 2022 and 23:59 BST on 26th June 2022 inclusive.

2.2. There are three photography competition categories in Canon’s 2022 Between The Lines Student Photography Competition that may be entered into to win 1 of three sports photography experiences (one (1) winner of each category) at the Birmingham 2022 Commonwealth Games:

a. Humanity
b. Destiny
c. Equality

2.3 To enter visit: https://www.canon.co.uk/get-involved/competition/between-the-lines and complete the online entry form and submit one (1) photographic image per category of the competition that the Participant selects to enter (up to 3 in total) meeting the criteria listed below in Clause 3 to be entered into the applicable competition category.

2.4 No purchase is necessary. It is free to enter this competition and images do not have to be taken on a Canon device.

2.5. Internet access and a valid email address are required to enter.

2.6. A maximum of 3 entries, one per category, are permitted per person during the Promotion Period, but any Participant may only win once. Each entry per category must be of a new image; the same image cannot be entered more than once.

2.7. Incomplete, invalid or inappropriate entries, or entries received after the closing date on the 26th June 2022 at BST 23:59 will not be eligible for publication or any prize.

2.8. By submitting an entry, each Participant hereby grants to Canon Group a non-revocable, worldwide, royalty-free and free of charge, sublicensable licence to publish, republish, display and use their image(s) for all purposes connected with this competition, including but not limited to display on Canon Group websites, Canon Group social media accounts and/or channels, any other websites of Canon Group or its agents/contractors, and in marketing materials (including at exhibitions) relating to this competition for up to one year after the competition ends. Each Participant also grants Canon Group and its agents/contractors the right to moderate, modify or remove any image if it is deemed unsuitable, in whole or in part, for display on the competition website or in any materials relating to the competition. Participants of the competition also hereby agree to being identified and/or attributed as the photographer or creator of the image subject to their entry.

3. IMAGE CRITERIA

3.1. The image submitted in each applicable category must meet the following challenges:

a. Humanity – a photograph that conveys benevolence, togetherness, or human nature
b. Destiny- a photograph that conveys fate, aspiration or ambition
c. Equality- a photograph that conveys collective spirit, fairness, non-discrimination or inclusion


3.2 The image(s) submitted in any of the categories must reflect the following criteria:

a) Creativity – Is your entry fresh and original?
b) Impact – Does your submission provoke strong thoughts, emotions, or reactions?
c) Technical prowess - Has the image been captured in a way that demonstrates an understanding of the abilities of the camera and the subject?

3.2. Image size should be 150DPI, 2000 px along the longest side. Participants must not upload images which have been previously published or won an award or prize via a promotion run by the Promoter or any other entity

3.3 The image submitted must not be heavily edited or manipulated, examples include: no adding or removing objects from the image, no compositing images and no watermarks (for further details please refer to clause 4.2 vi). Please note, this list of examples is not an exhaustive list.

4. COMPETITION REQUIREMENTS

4.1. The image(s) must be original and taken by the Participant.

4.2. The image(s) submitted by the Participant must not contain:

i) recognisable persons, unless the Participant can demonstrate that such persons have granted all the necessary permissions in writing for the image to be submitted, used and published by Canon Group under Clause 2.8 of these Terms and Conditions (please note, it is the responsibility of the Participant to ensure that the relevant permission has been sought and model release forms have been satisfactorily completed); or
ii) works of art unless the Participant can demonstrate that the Participant has been granted a licence to have such works of art used and published by Canon Group under Clause 2.8 of these Terms and Conditions or
iii) logos or brand names unless the Participant can demonstrate that the Participant has been granted a licence to have such logos or brand names used and published by Canon Group under Clause 2.8 of these Terms and Conditions; or
iv) scenes which are offensive, obscene, sexual, derogatory, defamatory, violent, abusive, harassing, threatening, objectionable with respect to race, related to religion, origin or gender, or which could reflect negatively upon the name, reputation or goodwill of Canon Group or any brand partner, or which are otherwise unsuitable for publication; or
v) anything that may infringe the rights of any third party, including intellectual property, moral or privacy rights, or refer to any third-party brand or reference any third-party names, logos and/or trademarks; or
vi) any watermark, copyright notice or any other information which may identify the Participant (note, a copyright notice embedded in the metadata of the image is permissible). For the judging process to remain as fair as possible, the judging panel is not permitted to see the names of the Participants when judging. Any image entered that contains a Participant’s name, any watermark, copyright notice or any other information which may identify the Participant, will be disqualified and will not be presented to the judging panel.

4.3. You also agree to be contacted by Canon for the purposes of administrating the competition or in the event that Canon Group wishes to discuss any other use of the image(s) submitted to the competition.

5. WARRANTIES

By submitting its entry, the Participant warrants that:

5.1. the Participant is the sole author of the image(s);
5.2. the Participant is the owner of the proprietary rights in the image(s);
5.3. the image(s) and any element appearing in the image do not infringe any rights (including intellectual property, moral or privacy rights) of any third party;
5.4. in the case where a person or person’s image appears in the image(s), the Participant has obtained written permission from those person(s) for Canon Group to use their image(s) as described in these Terms and Conditions; and
5.5. in the case where the image(s) has been taken in another country than in the Participant’s country of residence, the Participant has complied with the law applicable to such country, including but not limited to any intellectual property, moral, privacy and proprietary legal requirements.

Canon warrants that:
5.7. It shall act within the scope of the rights granted under and/or in accordance with these Terms and Conditions.

6. THE PRIZES

6.1. A total of three overall winners will be selected one (1) from each category of the competition. Each of the three (3) winners will each win the following prize:

• One (1) x a sports photography experience (for each winner only) at the Birmingham 2022 Commonwealth Games (the “Games”) with the Professional Photographer Paul Cunningham. The photography experience will take place on Wednesday 3rd August 2022 (between 8am and 5pm BST) at the Alexander Stadium, Birmingham during the Athletics and Para Athletics events and will include:

o the opportunity to photograph an Athletics and Para Athletics events live
o Mentorship throughout the experience from the professional sports photographer Paul Cunningham
o A post-shoot editing session with Paul Cunningham
o Lunch and refreshments will be provided during the photography experience.

As the photography experience involves some trackside and stadium access this experience is subject to the winner undergoing an accreditation/security background check as referred to in Clause 7 below.

• One (1) pair of tickets for: one (1) x winner and one (1) x guest to attend the morning session of the Athletics and Para Athletics at the Alexander Stadium, Birmingham on Thursday 4th August 2022.

• Two nights at a hotel accommodation in Birmingham for the winner and guest to share a double or twin room (including breakfast) for Tuesday 2nd August 2022 and Wednesday 3rd August 2022.

• Allowance towards reasonable travel to and from the hotel for the winner and their guest (e.g. flights from NI) or train (from UK) or 45p mileage allowance for car journeys (up to £120 per person) .

• Loan of Canon photography equipment to the winner for use during the photography experience.

6.2. NOT included in the prize:

• All spending money and other expenses are costs for the winner and their guest
• Meals and refreshments are excluded (other than as otherwise stated in Clause 6.1 above)
• Travel insurance is not included, travel insurance if required, is the responsibility of the winner and their guest.
• If the winner and guest travel by car all car parking arrangements and costs are costs for the winner and their guest


6.3 TICKETS TERMS AND CONDITONS

The winners may not sell the tickets. The winners may use the tickets only for their personal use and that of their guest. The winners must retain at least one (1) ticket for their own personal use and may only transfer any remaining ticket to their guest for their personal use (provided always that the guest is a person who is known to each winner personally and who did not become known to each winner through the transfer of the ticket) and not for commercial gain. The tickets are subject to all applicable ticket terms and conditions and venue entry conditions. 6.4 PHOTOGRAPHY EXPERIENCE CONDUCT RULES

Prize winners must comply with Birmingham 2022’s Photographer’s Code of Conduct and a copy of this will be provided to winners prior to the photography experience.

6.5 Prize winners will be asked to take part in a film captured by Canon during the photography experience for its promotional use and that of the organising bodies relating to this promotion and any future promotion e.g. via social media. If any of the winners do not wish take part in the film, they must advise Canon at the time of being notified that they have won.

6.6 Canon will notify the winners via the email address provided on entry within 5 working days of the winner selection and will be required to respond to confirm eligibility and acceptance of the prize, within 7 calendar days of initial contact. If a winner does not respond to the initial contact within 7 calendar days Canon reserves the right to disqualify that winner. If a winner is disqualified Canon reserves the right to award the prize to a reserve selected in the same manner. Reserve winners may have less time to respond.

6.7. Canon reserves the right to publish the name and town and county of the winner or to publicise any prize giving presentation after the date of the competition. If the winner does not wish such details to be published, they must advise Canon at time of being notified that they have won. In such circumstances, the Promoter must still provide the winners information and winning entry to the Advertising Standards Authority on request.

6.8. The prize is non-transferable and no cash or credit alternatives will be substituted for the prize or any part of the prize on offer. In the event that the prize offered or any part of the prize offered is unavailable due to circumstances beyond our control, Canon reserves the right to offer an alternative prize of equal or greater value.

6.9. Any rejected or unclaimed prize may be awarded to other entrants at the absolute and sole discretion of Canon.

6.10. In the event that the competition is not capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, dishonesty, technical failures, or any other causes beyond the control of Canon which corrupt or affect the administration, security, fairness, integrity or proper conduct of this competition, Canon reserves the right to disqualify any individual who tampers with the entry process or does not comply with these Terms and Conditions and to cancel, modify or suspend the competition or invalidate any affected entries.

6.11. No responsibility can be taken for entries which are lost, delayed, corrupted, damaged, misdirected or incomplete or which cannot be delivered for any technical, delivery or other reason. Proof of sending will not be accepted as proof of receipt. Canon Group does not guarantee continuous or secure access to the entry page.

7. GAMES ACCREDITATION

7.1 All winners will undergo a security background check by the Birmingham 2022 Commonwealth Games Organising bodies before they will be allowed to take part in the photography experience.

8. WINNER SELECTION

8.1. All valid entries received during the Promotion Period will be judged by a panel of three judges. There will be a total of two (2) rounds of judging to shortlist thirty (30) finalists based on the image criteria as detailed in Clause 3. From the thirty (30) finalists, the judging panel will select three (3) winners.

8.2. The winner will be selected between the 27th June 2022 to the 30th June2022.

9. PERSONAL DATA

9.1. Canon (UK) Limited, is the Data Controller in respect of any personal data supplied by Participants. The personal data provided is held securely and may be transferred on a secure server outside the country of the data subject’ domiciles. The personal data collected from Participants is subject to the Canon Consumer Privacy Policy https://www.canon.co.uk/privacy-policy/.

9.2. Canon may pass personal information relating to entrants or prize winners to The Birmingham 2022 Commonwealth Games Organising Committee Limited and related organising bodies (and any of their service providers or agents) for the purposes of (a) carrying out the accreditation and (b) monitoring the distribution and use of the tickets and the photography experience and, in the event of a suspected breach of any terms and conditions, rules or regulations relating to the use of such tickets and/or experiences, investigating and taking action against such winners (and their guest if applicable)

9.3 Any and all personal data supplied for the running of this competition will be used solely for the purpose of this competition and, if applicable, for marketing purposes by the Canon Group and/or by any agent or third party supplier appointed by it to assist with running the competition on behalf of the Promoter and will not be disclosed to a third party for any other purpose unless your positive consent has been obtained.

10. DISCLAIMER

10.1. Canon reserves the right to refuse to honour any entry or to recover the full value of any prize if it considers there has been an abuse or breach of the Terms and Conditions of this competition.

10.2. Canon together with any associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using the Prize, except for any liability which cannot be excluded by law. Nothing will exclude the Canon Group’s liability for death or personal injury as a result of its negligence.

10.3. In the event of a dispute over interpretation or implementation of the rules on any matter related to the competition, the decision of the Directors of Canon is final and no correspondence will be entered into.

10.4. If any part of these conditions is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable, then such part shall be severed from the remainder of these conditions, which shall continue to be valid to the fullest extent permitted by law.

10.5. Entries must be made directly by the individual entering the competition. Bulk entries from trade, consumer groups or third parties will not be accepted. Incomplete or illegible entries and entries submitted by macros or other automated means together with entries which do not satisfy the requirements of these Terms & Conditions in full will be disqualified and will be not be counted. If it becomes apparent that a Participant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that Participant’s entries into the competition in a way that is not consistent with the rules of the competition, that Participant ’s entries will be disqualified and any prize awarded will be void. Participants are not permitted to enter using anonymous email services such as, but not limited to, GuerillaMail, Dispostable or Mailinator.

10.6. In the event of a discrepancy between these Terms and Conditions and the details in any promotional material, the details in the Terms and Conditions will prevail.

11. JURISDICTION

These Terms and Conditions shall be governed by English Law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
